A British judge has cautioned people to stay away from the complex process of litigation.

The judge made the comment as he turned down a restaurant owner’s appeal to challenge the ruling of a tribunal that made it mandatory for him to compensate a women employee who was dismissed unfairly.

Jacqueline Marley had made an unfair dismissal plea before the Employment Tribunal after her services at a Plymouth-based restaurant were terminated. Marley, suffering from a back condition and Carpel Tunnel Syndrome, claimed that she was unfairly thrown out of her job due to her disability. The tribunal upheld her claim and asked David Piper’s company Brentegani’s Bistro Ltd., which managed the café, to pay Marley a compensation sum of £14,777.

Piper then took the case to the Employment Appeal Tribunal (EAT) but could not file the Notice of Appeal within the six-week deadline. He then filed an appeal in London’s Civil Appeal Court, arguing that he had personally gone to the EAT to file the papers but its office was closed. He also said the building had no post boxes and asked the court to waive the time limit.

However, Lord Justice Mummery did not concede Piper’s request, saying the six-week time limit was sufficient. He added that Piper would not have had much success in overturning the tribunal’s decision anyway.
